Law students usually look into the law currently in force. Some of them also study legal history. But who cares about the law of the future?
In the new legal world attorneys and law firms and in-house legal departments respond quickly to the pressures of an on-demand economy and the career and business risks associated with a volatile legal market. Brick & mortar staffing agencies (with their paper, antiquated processes, lack of transparency and high overhead) have to go. Legal recruiting and staffing need to be rebuilt with digital technology – some have started doing so.
German lawyers' regulation is now open for modern information technology and legal tech. Confidentiality can and must be preserved, data protection laws are to be complied with. The use of clouds hosted outside of Germany is permissible if the level of protection provided is comparable. There are still obstacles but over time any deficiencies will be overcome. It is up to the legal profession to grasp opportunities in the field of technology and to work creatively and efficiently while preserving confidentiality as a core value of the legal profession.
Lawyers in the middle ages used to write their briefs themselves until they began to have secretaries. They did their research themselves until they started having associates. Lawyers should regard Legal Tech not primarily as a danger for themselves. They should rather use it themselves in order to serve their clients better and more efficiently. Regulation of the legal profession cannot and under the constitution, as long as the professions's core values are safeguarded, must not stop factual developments in the legal profession that are not per se illegal.
